Approaches & Advantages

Some Approaches to Consider:

Collaborative Law provides parties and their attorneys with a formal and strictly non-adversarial approach to resolving legal disputes. It encourages mature, cooperative and non-combative behavior, as the parties contract to eliminate litigation as an option. It has the benefits of being confidential, cost effective, and less time consuming than litigation.

Advantages of Collaborative Law

  • Open, constructive dialogue that helps you make the best decisions for your situation.
  • Less costly and time-consuming than litigation.
  • The settlement team consists of both parties - you're equally involved in the process.
  • You work cooperatively with your spouse and/or his/her lawyer.
  • You are supported by professionals who want the best outcome for each of you.
  • The process is less stressful than Court proceedings.
  • Everyone can be focused on a positive outcome.
  • There is greater possibility for "win-win" settlements.
  • The process is less time-consuming.
  • You control the proceedings - the parties decide rather than leaving it to the courts.
  • The possibility of a positive working relationship with your 'ex' is increased.
Mediation is a process in which a neutral third party meets jointly with parties to the dispute. The mediator assists the disputants in crafting a resolution to the conflict. Mediation is generally a voluntary process that has the benefits of being confidential, cooperative, cost effective, and less time consuming than litigation.

Arbitration is a process in which parties agree to present their dispute to a third party neutral. Arbitration differs from mediation in that the third party neutral presides over a formal hearing at which evidence is presented, arguments are made, and the Arbitrator is empowered to render a legally binding decision. Arbitration is generally a voluntary process. It has the benefits of being confidential, cost effective, and less time consuming than litigation. Arbitration also offers predictability and control over the costs associated with a conflict.
